TET Tapping Mentoring Program Terms and Conditions
The TET Tapping Mentoring Program (hereinafter referred to as the "Program") is provided as a service of The Rejuvenation Station, LLC.
By signing where indicated below, you (hereinafter referred to as the "Participant") irrevocably agree that, if Jan Luther and The Rejuvenation Station, LLC, (hereinafter referred to as the "Mentor") approves your application and accepts you as a participant in the Program, then this TET Tapping Mentoring Program Terms and Conditions (hereinafter referred to as the "Agreement") automatically becomes a binding contract between the Participant and the Mentor and applies to your participation in the Program.
PARTICIPANT CONDUCT
Mentor is committed to providing all Program participants with a positive Program experience. By signing below, Participant agrees that the Mentor may, at its sole discretion, terminate this agreement, and limit, suspend, or terminate Participant's participation in the Program without refund or forgiveness of remaining monthly subscription payments if Participant becomes disruptive or difficult to work with, if Participant fails to follow the Program guidelines, or if Participant impairs the participation of Program instructors or participants in the Program.
LIABILITY WAIVER: PARTICIPANT SAFETY
While we take every possible measure to ensure Participant safety during the Program, we cannot control everything. For this reason, every Participant is legally responsible for their own safety, health, behavior, results and possessions and agrees to – and is held legally liable to – release Mentor from all liability. Participant hereby agrees to the following statement:
“I, the willing Participant of the Program, hereby accept all risk to my health, property and of my injury or death that may result from participating in the Program and I hereby release Mentor, Jan Luther, the Site, and their officers, employees, interns, contractors, sponsors and representatives from any and all liability to me, my personal representatives, estate, heirs, next of kin and assigns for any and all claims and causes of action for loss of or damage to my property and for any and all illness or injury to my person, including my death, that may result from or occur during my participation at the Program, whether caused by negligence of the Mentor, its owner, or representatives, or otherwise. I further agree to indemnify and hold harmless Mentor and any third-party company from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in the Program. Under no circumstances will Mentor be held liable for my injury or death due to my participation in the Program. I will notify Mentor verbally and in writing if I have medical conditions about which emergency medical personnel should be informed; however, I understand that Mentor is not legally obligated to act on that information in any way or to provide any medical service whatsoever to me. I agree that if I have any medical or psychological conditions that may hamper me from fully and healthfully participating in the Program I will notify Mentor and that the Mentor retains the right to ask that I not participate in portions and/or the entirety of the Program.”
LIABILITY WAIVER: NO PROFESSIONAL ADVICE
The information contained in or made available through Mentor’s Program, websites or services cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, mental, financial, medical, psychological, sales or legal fields. Mentor does not offer any professional, medical, financial or legal advice and none of the information contained in the Program should be confused as such advice. Neither Mentor nor its sponsors, speakers, partners, contractors or any of their affiliates will be liable for any direct, indirect, consequential, special, exemplary or other damages, including economic loss, that may result from the use of, or the inability to use, the materials, information or strategies communicated through the Program, or any products or services provided before or after the Program, even if advised of the possibility of such damages.
ADULT CONTENT
During the Program, we may discuss several adult topics relating to personal and professional growth. We may, in some cases, use explicit language to emphasize a point or further connect with the participants in the Program (though we will never be lewd and we will always use tact and discretion in doing so). Participants who are uncomfortable with such topics and/or language should not attend the Program. Children under the age of 18 are not allowed in the Program.
NO RECORDINGS AND AUDIO/VISUAL RELEASE
Participant understands that he/she may not record in audio or video, in any form or for any duration, the information presented in the Program. Participant also understands that the Mentor will be making video and audio recordings of the Program. Participant agrees that the Mentor and its assigns have the right and permission to use such recordings should they include the Participant’s name, likeness, voice, city/state of residence, photograph, or appearance on video for advertising or any other purpose in any media or format, online and/or offline, now or hereafter without further compensation, permission or notification. Participant understands that all recordings from the Program are the exclusive rights of the Mentor and does not ask for or expect compensation or notification of the use of recordings or photographs in which he/she appears or speaks.
CONFIDENTIALITY AND NON-COMPETE
Participant hereby understands that the tools, stories, concepts, strategies, materials and information presented in the Program are confidential, copyrighted and proprietary to the Mentor and agrees not to record, duplicate, distribute, teach or train from the Program materials and information in any manner whatsoever without the express written permission of the Mentor. Any unauthorized use or distribution of these proprietary concepts, materials and intellectual property by the Participant or their representatives is strictly and legally prohibited. Mentor will pursue legal action and full damages if these terms are violated in order to protect its rights.
Participant agrees not to violate the publicity or privacy rights of any Program participant. Mentor respects your confidential and proprietary information ideas, plans and trade secrets (collectively, "Confidential Information") and must insist that you respect the same rights of fellow Program participants. By signing below, you agree (1) not to infringe any Program participant's copyright, patent, trademark, trade secret or other intellectual property rights; (2) that any Confidential Information shared by Program participants is confidential and proprietary and belongs solely and exclusively to the Participant who discloses it; (3) you agree not to disclose such information to any other person or use it in any manner other than in discussion with other Program participants during the Program; you further agree that (4) the reproduction, distribution and sale of these materials by anyone except the Program participant is strictly prohibited. Further, by signing below, you agree that, if you violate, or display any likelihood of violating, any of your agreements contained in this paragraph the other Program participant(s) will be entitled to injunctive relief to prohibit any such violations to protect against the harm of such violations.
FEES AND SUBSCRIPTIONS
Participant understands that, in addition to the Program's monthly subscription payment, there are additional purchases required. Participant agrees to devote at least 3 hours per week for the duration of the Program to complete the mentoring and certification process. Participant also understands that once Participant has signed I have signed my agreement contract for mentoring at The EGO Tamer® Academy that there are no refunds.
MISCELLANEOUS
These terms will be governed by and construed in accordance with the laws of the State of North Carolina without regard to any principles of conflicts of law. Mentor agrees to try mediation using a mediator of the Mentor’s choice. If mediation is not used, Participant agrees that any action at law or in equity that arises out of or relates to these terms will be subject to binding arbitration in accordance with the American Arbitration Association and will be arbitrated in North Carolina. This is the entire agreement of terms and conditions between Participant and Mentor relating to the subject matter it contains. The terms and policies, including updates, may be viewed on the Program website.
SEVERABILITY
Should any provision of this agreement, or part thereof, be held invalid, the remaining provisions, or part thereof, shall remain in full force and effect.
AGREEMENT TO TERMS AND CONDITIONS
By applying for the Program and by signing below, Participant is acknowledging that he/she has read, agrees to and accepts all of the terms and conditions contained in this Agreement. If Participant has objections to the conditions outlined in this Agreement, Participant should not apply for and may not participate in the Program.
